1. About GNCreators

GNCreators is an Instagram-first creator growth platform providing: Link-in-Bio pages, Instagram AutoDM automation, lead capture tools (lead magnets, giveaway funnels, forms), a unified lead inbox, DM qualification flows, and brand campaign access. All features connect to your Instagram account via the Meta Graph API and operate within Instagram’s Messenger Platform Policy.

2. Eligibility

You must be at least 18 years of age to use GNCreators. You must have a valid Instagram Business or Creator account and grant the required Instagram permissions to use automation features. By using GNCreators, you confirm that you have the authority to bind yourself or your organisation to these Terms.

3. Account Registration

You register for GNCreators via Instagram Login. You are responsible for all activity under your account and for keeping your connected Instagram permissions current. Notify us immediately at info@gncreators.com if you suspect unauthorised access to your account.

4. Plans and Billing

4.1 Free Plan

The Free plan is available to all creators at no cost. Usage is subject to the quotas published on our Pricing page. Quotas are enforced at the server level.

4.2 Pro Plan

The Pro plan is ₹499 per year (inclusive of GST). Any other billing cycle we offer is charged at the rate published on our Pricing page. The Pro plan removes usage limits on core features as described in the plan comparison.

4.3 Billing

Subscriptions renew automatically at the end of each billing cycle. Payments are processed by Razorpay. Upgrades take effect immediately. Downgrades take effect at the end of the current billing period. We will give 30 days’ notice of any price changes to existing subscribers.

5. Creator Responsibilities

When you use GNCreators, you agree to:

(a) Use all automation features — AutoDM, Comment-to-DM, story-reply triggers — in strict compliance with Meta’s Instagram Messenger Platform Policy and Instagram Community Guidelines.

(b) Only send automated messages to users who have engaged with your content in a manner permitted by Instagram’s platform policies.

(c) Ensure all lead capture forms include appropriate consent language and that you have the right to contact captured leads under applicable data protection law.

(d) Comply with India’s Digital Personal Data Protection Act 2023 (DPDP Act) for the contacts you collect through the platform.

(e) Not use GNCreators to send spam, conduct deceptive campaigns, or impersonate any person or entity.

6. Instagram Policy Compliance

GNCreators integrates with Instagram via the Meta Graph API. Our AutoDM and messaging features operate within Instagram’s standard messaging window and permitted message types. Built-in guardrails prevent rules that violate Meta’s policy from going live. You acknowledge that:

(f) Instagram’s policies may change independently of GNCreators, and we cannot guarantee that all features will remain available if Meta changes its platform terms.

(g) Misuse of automation features — beyond what GNCreators’s policy guardrails prevent — may result in restriction of your Instagram account by Meta, for which we bear no liability.

(h) GNCreators is not affiliated with, endorsed by, or officially connected to Meta Platforms, Inc.

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of all content you create on GNCreators — Link-in-Bio pages, lead magnets, giveaway campaigns, and forms. By publishing on GNCreators, you grant us a limited, non-exclusive, royalty-free licence to display and host that content solely to provide the service.

7.2 Our Platform

GNCreators — including its software, design, trademarks, and technology — is owned by GrooveNexus Entertainment and Media Services Private Limited and protected by applicable intellectual property law. You may not copy, reverse-engineer, or create derivative works from the platform without written consent.

8. Lead Data Ownership

All contacts captured through your Link-in-Bio page, lead magnets, forms, and giveaway funnels belong to you. GNCreators acts as a data processor on your behalf. You are the data controller for your leads under applicable data protection law and are responsible for lawful processing of that data.

9. Prohibited Uses

You may not use GNCreators to:

(i) spam or send unsolicited messages to Instagram users;

(j) conduct fraudulent giveaways or deceptive lead capture campaigns;

(k) collect personal data without appropriate consent;

(l) infringe third-party intellectual property;

(m) circumvent Instagram’s rate limits, automation restrictions, or community guidelines;

(n) resell or sublicence GNCreators without prior written consent;

(o) attempt to access, reverse-engineer, or compromise platform security.

10. Objectionable Content and Abusive Behaviour

GNCreators has zero tolerance for objectionable content and abusive behaviour. You may not post, upload, publish, transmit, or share content that is:

(p) harassing, bullying, or threatening toward any person;

(q) hate speech, or content that attacks or demeans a person or group on the basis of race, ethnicity, national origin, caste, religion, sex, gender identity, sexual orientation, disability, or serious disease;

(r) sexually explicit or pornographic, or that sexualises a minor in any way;

(s) violent or graphic, or that incites or glorifies violence or self-harm;

(t) unlawful under Indian law, or that promotes illegal activity;

(u) impersonating another person, creator, or brand; or

(v) otherwise obscene, defamatory, or objectionable.

This applies everywhere your content is visible to another person — your creator profile and directory listing, your Link-in-Bio and bio pages, lead magnets, giveaways and forms, and any message or reply sent through the platform.

Zero tolerance means there is no warning tier under this clause. Content that breaches it is removed, and the account that posted it may be terminated immediately and without notice.

11. Reporting Objectionable Content

Every piece of content another person can put in front of you carries a report control. Open the ⋯ (more options) menu on a creator’s profile, on an Instagram comment, or on a submission you have received, choose Report, pick a reason, and submit. You may also write to info@gncreators.com.

Reports are reviewed by a person, not by an automated filter. Reporting does not by itself hide the content — it opens a moderation case, which we resolve under clause 13.

12. Blocking Other Users

You can block any creator on GNCreators from the ⋯ (more options) menu on their profile. Blocking is mutual and takes effect immediately: you and the blocked creator stop appearing in each other’s directory, search results, and profile pages. Everyone else continues to see you both.

Blocked accounts are listed under Profile → Blocked accounts, where you can unblock at any time. Where you tell us what prompted a block, we treat that as a report as well.

13. Our Response to Reports

We act on every report of objectionable content or abusive behaviour within 24 hours of receiving it.

Where we uphold a report, we remove the offending content from the platform — a bio page stops resolving, a Link-in-Bio page is withdrawn, a directory listing disappears — and we eject the user who posted it where the breach warrants it. Content held on a third party’s servers, such as an Instagram comment or direct message, is removed from your GNCreators views and retained as evidence; we cannot delete it from Instagram.

14. Disclaimers

GNCreators is provided ‘as is’ and ‘as available.’ We do not guarantee the platform will be error-free or uninterrupted. Instagram API availability is outside our control and may affect feature functionality. We do not guarantee specific results including leads captured, DMs delivered, or follower growth.

15. Limitation of Liability

To the maximum extent permitted by applicable law, GrooveNexus Entertainment and Media Services Private Limited shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of GNCreators. Our aggregate liability for any claim shall not exceed the amount you paid to us in the three months preceding the claim.

16. Indemnification

You agree to indemnify and hold harmless GrooveNexus Entertainment and Media Services Private Limited from claims, damages, costs, and expenses arising from: (a) use of GNCreators in violation of these Terms; (b) violation of Instagram’s platform policies; or (c) content you publish through GNCreators.

17. Suspension and Termination

We may suspend or terminate your account if you violate these Terms or misuse automation features. A breach of clause 10 (Objectionable Content and Abusive Behaviour) may result in immediate termination without notice and without the retention period described below. On termination, your data is retained for 30 days in read-only state before deletion — giving you time to export your leads via the CSV export function. Free plan data above quota on downgrade is preserved read-only and never deleted without notice.

18. Changes to These Terms

We may update these Terms at any time. Material changes are communicated via in-app notification or email at least 15 days before they take effect. Continued use after the effective date constitutes acceptance.

19. Governing Law

These Terms are governed by the laws of India. Any dispute arising from these Terms is subject to the exclusive jurisdiction of the courts of Delhi, India.
